Your Right to Medical Benefits
If you are a worker that has been injured in a work related accident, there are a couple of things you should know:
- Your right to treatment is not limited: If you are eligible for workers' compensation benefits, your employer must pay for all of your reasonable and necessary medical treatment, including the cost of future treatment that is necessary as a result of your work injury. There is no limit to the amount of medical treatment you may receive as long as it is reasonable, necessary and directly related to your work injury. - You have a right to a second opinion: If your doctor gives you an impairment rating that is low, you have a right to a second opinion and your employer must pay the expense of your doctor appointment, including mileage to that appointment.
- The system is stacked against you: As a general rule, your employer has a right to choose the doctor you see. There are exceptions, but people who are not represented by an attorney often do not know how to exercise their rights. Since the employer (or their insurance company) pays the doctor, the doctor may feel pressured to say that the employee is ready to return to work sooner than is actually the case. Never be afraid to ask a qualified attorney questions about your workers' compensation rights. Lawyers do not charge to answer questions!
